FMCSA NEW RULES
Effective September 19, 2015

IMPACT AREAS

1. Commercial Leaner’s Permit

A. Restriction 10 still applies (Accompanied by a licensed driver)
B. Permit cannot possess the Hazardous Material Endorsement
C. Are non-transferable
D. Must be held for 14 days prior to conducting the skills examination
E. Valid for 180 calendar days
F. A CDL permit holder with a CMV carrying passengers (Will have the P restriction added automatically)
G. A CDL permit holder with an N endorsement can not operate a tank vehicle that is loaded. (Must be empty and if a hazardous material load, a purge letter must accompany driver)
Will have the X restriction added automatically

2. Restrictions

(E) – No manual transmission (New)
Skills test administered in a CMV with an automatic transmission.

(K) – Intrastate Only (Was 4)
Under the age of 21
Visual Acuity of less than 20/40
Has missing extremities
State waiver

(L) – No Air Brakes (No Change)
Did not take the skills test in a vehicle equipped with air brakes

(Z) – No Full Air Brakes (New)
Did not take the skills test in a vehicle equipped with air full air brakes. (Air over hydraulics…air line that powers a hydraulic pump that engages the brakes)
Brake chambers/slack adjusters not present

(M) – Passenger Class B & C (Was 14)
Applies when the driver has a Class A CDL but takes the skills test for the passenger endorsement in a Class B vehicle.

(N) – Passenger Class C (Was 15)
Applies when the driver has a Class A or B CDL but takes the skill test for the passenger endorsement in a Class C vehicle.

(O) – No Tractor-Trailer (Was 8)
Applies when the vehicle being used for the skills test is not a tractor-trailer.

(P) – No Passengers In A CMV Bus (New)
Commercial Learner’s Permit only With P Endorsement

(X) – No Cargo In Tanker (New)
Commercial Learner’s Permit only With N Endorsement

5th Wheel Restriction

FMCSA regulation 383.95 (d) Tractor-trailer. If an applicant performs the skills test in a combination vehicle for a Class A CDL with the power unit and towed unit connected with a pintle hook or other non-fifth wheel connection, the State must indicate on the CDL, if issued, that the person is restricted from operating a tractor-trailer combination connected by a fifth wheel.
